Kaikua Private Tours – Liability Waiver & Release

 

By booking a tour with Kaikua Private Tours, you acknowledge and agree to the following:

 

1. Assumption of Risk

Participating in a tour may involve walking, hiking, uneven terrain, entering and exiting a vehicle, exposure to sun and heat, proximity to the ocean, slippery surfaces, and other natural outdoor conditions. By joining the tour, you voluntarily accept all risks of injury, illness, accidents, or property damage that may occur during the tour.

 

2. Release of Liability

You release and hold harmless Kaikua Private Tours and its owner/operator from any claims, demands, or liability for injuries, accidents, or damages arising from your participation, except in cases of proven gross negligence.

 

3. Health & Personal Responsibility

You confirm that you are physically able to participate in walking, hiking, and outdoor activities. You are responsible for your own hydration, sun protection, footwear, and personal health needs, and you agree to disclose any medical or mobility conditions that may affect your participation.

 

4. Transportation Acknowledgment

You understand that entering, exiting, and riding in a vehicle carries inherent risks, and you accept responsibility for your own safety while in or around the vehicle.

 

5. Medical Costs

If you are injured during the tour, you agree that you are responsible for any medical treatment or expenses that may result.

 

6. Agreement

By checking the box during booking, you confirm that you have read, understood, and agree to this waiver. You are participating voluntarily and accept all terms above.
